Myanmar yet does not have a specific trade mark law in force. It is expected the Trade mark law will soon come into force. The law concerning trade marks is contained in different statues such as the Penal Code of 1860 and the Registration Act. Currently, trade marks in Myanmar are filed in the form of a “Declaration of ownership of trade mark” under section 18 of the Registration Act. Each trade mark can be filed using one declaration.
Requirements for trade mark registration in Myanmar
· Applicant should be a citizen of Myanmar, if a foreign citizen, then he must act through an agent with an address in Myanmar. · Applicant must execute Declaration of ownership of trade mark under Section 18 of the Registration Act. · A special Power of Attorney must be executed by the foreign applicant in favour of the local agent. · A cautionary notice should be published in a Myanmar newspaper, advertising the mark’s ownership.
Trade Mark renewal in Myanmar
Trade mark renewal in Myanmar is not compulsory but may be renewed every 3 to 5 years. To renew a trade mark a submission of the Declaration of ownership of trade mark and Power of Attorney is required.
