Patent Registration in Bangladesh
There are two categories for filing a Patent Application in Bangladesh:
Ordinary Application:
The Application is directly filed before the Bangladesh Patent Office.
Convention Application:
This particular Application is first filed in another country. The same application should follow within 12 months in Bangladesh. It can claim single or many priorities from such an application.
Procedure for filing a Patent Application in Bangladesh
Anyone can file a Patent Application in Bangladesh before the Department of Patents, Designs & Trademarks. The Application should contain Form - 1 or 1A/2 or 2A. The Form will specify the name, address, and nationality of the applicant or inventor. The Application should include the complete specifications in Form 3A. It should be in English comprising the description, claims, abstract and formal drawings. The Application should include one set of drawing sheets in tracing paper with a duplicate in photocopy. If the applicant is not the sole inventor, then the inventor should endorse the applicant. The Application should include an original Power of Attorney. The same can be filed within one month after filing the Patent Application. For Priority Application, a certified copy of the Priority Document must be present. It can be filed within 3 months of filing the Application. Notarised and verified English translation of the Priority Document. In case the Document is in any other language.
Who can file for Patent registration in Bangladesh?
Patent and Design Act (1911) and Patents and Design Rules (1933) cover patent rights. According to Section 3 of the Patent and Design Act, 1911, any person can make an Application for a Patent. An applicant can file the Patent alone or with some other person.
Prosecution of Patents in Bangladesh
Acceptance and publication of the Patent Application within 18 months. The Opposition period is 4 months from the date of publication of the Patent. If there is no Opposition, the DPDT must inform the applicant and request sealing fees. On the payment of sealing fees, the DPDT Controller grants the patent. The letter Patent Document is then issued. The proprietor thereafter must pay renewal fees to keep the Patent in force.
Term of Patent in Bangladesh:
The term of a Patent in Bangladesh is for 20 years.
Remedy for Patent infringement in Bangladesh:
The Patent owner should follow civil litigation when there is any infringement. The court will pass the order for search, seizure and damages.
