Everything is fair in education

Considering the higher cost of education in India the High Court has passed the judgment in the DU Photocopy case in favor of DU. This had a far reaching implications on access to education in a developing countries like India. But the Oxford University Press was somehow not agreeing to the decision passed by the High Court.

It is in the above context that 122 alumnis of the DU have requested the Oxford University Press to refrain from filing an appeal in the Supreme Court against the decision of the High Court. The decision of the High Court highlights the Section 52(1)(i) of the Copyright Act, which permits copying of copyrighted extracts for educational purposes.

The course packs made with the copyrighted extracts from the books very well falls under the exception of the above mentioned Section of the Copyright Act. Moreover the high cost of the educational resources in India makes the materials imperative for studies inaccessible by the students. The Court held that considering the economic condition of the country as well as the unaffordable prices of the books, the course packs are an exception under the Act.

Now this case is en route to creating another landmark in the history of Copyright in India
